Terms of Service

Last updated: 22 October 2026

1. Who we are

The online store viadellerose.eu is operated by Luteks Têxtil, LDA, trading as VIADELLEROSE, with its head office at Rua direita de Pereiró, número 1946, Ramalde, 4100-214 Porto, Portugal. Portuguese tax identification number (NIF): 517511045. Contact: online@viadellerose.com.pt; +351 926 429 571.

“We”, “us” and “our” mean this company. Shopify provides our e-commerce platform. These terms govern use of this website and consumer purchases from this online store. A purchase from an independent retailer or another VIADELLEROSE website is governed by the terms of that seller.

2. Orders and customer information

You must have the legal capacity to enter into a purchase contract. Please provide accurate billing, delivery and contact details and review your basket before submitting an order. The checkout identifies the products, price, currency, delivery charge and other amounts collected by us before you place an order with an obligation to pay.

We send an order confirmation to the email address provided. If a product becomes unavailable or a genuine pricing or processing error affects your order, we will contact you, explain the situation and offer the appropriate correction or cancellation and refund. We will not impose a different price or substitute product without your agreement. Your mandatory rights in relation to a concluded contract remain unaffected.

If you wish to cancel before dispatch, contact us promptly. Once dispatch has taken place, any applicable withdrawal or return rights continue under our Returns & Refunds Policy.

3. Products, prices and payment

Product descriptions, materials, sizes and photographs help you assess the goods. Screens may display colours differently, but this does not excuse supplying goods that do not conform to their description.

The currency and total charged by us are shown at checkout. Applicable taxes collected by us and shipping charges are identified before you pay. For destinations where import charges are payable separately, the pre-purchase information explains that responsibility. Your bank or payment provider may apply its own currency conversion or payment fee.

Price changes apply to future purchases and do not retrospectively change an agreed order. A promotion is subject to the conditions disclosed with that promotion and does not remove statutory rights.

4. Shipping, import taxes and delivery

Read our Shipping & Customs Policy for destinations, delivery arrangements and the treatment of import charges for the UK, Switzerland and other customs destinations.

Shipping charges and free-shipping offers do not automatically include destination import taxes or carrier clearance fees. Any amounts payable separately must be explained before purchase. We remain responsible for taxes and charges that the law requires us to collect or bear.

Unless another period is agreed, delivery takes place without undue delay and within 30 days after the contract is concluded. Customs procedures do not create a blanket exemption from our delivery obligations or your cancellation and refund rights. Responsibility for loss or damage passes as required by applicable consumer law.

5. Returns and statutory withdrawal

Our Returns & Refunds Policy sets out our 30-day commercial return offer and the separate statutory right of withdrawal, including the procedure, return costs and refund timing. EU consumers generally have 14 days to notify withdrawal and another 14 days to send the goods back. Mandatory UK or other local rights also apply where relevant.

A discount, missing authorisation number or general “no returns” statement does not remove a statutory right. Neither customs notices nor these terms require you to waive a legal remedy.

6. Faulty or non-conforming goods

Goods must conform to the contract. If an item is defective, damaged, incorrectly supplied or not as described, contact us so that we can provide the remedy required by law. Available remedies can include repair, replacement, a price reduction or termination and a refund, depending on the circumstances and applicable law.

The commercial return period does not replace or shorten a legal guarantee. Where Portuguese law applies, new movable goods generally have a three-year legal guarantee from delivery. Any stronger mandatory protection applicable to your purchase remains available.

7. Accounts and acceptable use

Keep account access details secure and contact us if you suspect unauthorised access. Do not use the website for fraud, unlawful activity, infringement of rights, distribution of malicious software or interference with the service. We may take proportionate steps to protect the service from misuse. Such action does not remove an obligation relating to an existing order or a consumer's mandatory rights.

8. Website content and third-party services

Website text, photographs, branding and other content are protected by applicable intellectual property law. You may use the website to browse and purchase for personal purposes. Other uses require permission unless allowed by law.

Links to independent websites are provided for information. Their operators are responsible for their own services. Using a third-party payment or delivery service in fulfilling our contract does not remove responsibilities that remain ours under the law.

9. Personal data

Our Privacy Policy explains how personal data is used, the relevant legal bases and your choices. Accepting these terms is not consent to optional advertising cookies or marketing communications.

10. Liability

We are responsible for performance of our obligations under the contract and applicable law. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, or removes your rights concerning product conformity, delivery, personal injury or fraudulent conduct. We do not supply consumer goods on an “as is” basis that overrides those rights.

11. Complaints and dispute resolution

Please send complaints to online@viadellerose.com.pt, including the order number and a description of the issue. This contact route does not prevent you from using a complaints book, competent consumer dispute resolution body or court.

The Portuguese Electronic Complaints Book is available at livroreclamacoes.pt. Information about recognised consumer dispute resolution bodies in EU Member States is available from the European Commission's consumer dispute resolution directory. Jurisdiction depends on the dispute and applicable rules; a reference to a body is not a statement that we belong to every scheme.

12. Governing law and consumer jurisdiction

These terms are governed by Portuguese law. If you are a consumer habitually resident in another country, this choice does not deprive you of protection afforded by mandatory rules that apply under the relevant conflict-of-laws rules. You retain the right to bring proceedings before any court or use any dispute mechanism available to you under mandatory law. We do not require all consumers to bring claims exclusively in Portugal.

13. Updates and severability

We may update these terms for future use and purchases. The terms applying to your order remain those applicable when the contract was concluded, subject to mandatory law and any lawful agreement with you. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A provision cannot be used to remove a mandatory consumer right.
